“Shoddy Investigation” Cannot Sustain a Criminal Conviction

The Supreme Court acquitted the sole surviving accused in a kidnapping for ransom and murder case, holding that the prosecution failed to establish the accused’s guilt through legally admissible and reliable evidence.

📌 Key Takeaways:

• Confessions of co-accused cannot, by themselves, be relied upon to incriminate another accused.

• Electronic evidence must be duly proved as required by law. CCTV footage and call records were not relied upon as the mandatory certificate under Section 65B, Indian Evidence Act, 1872 was not produced.

• Call records were also not properly proved through the telecom service provider’s Nodal Officer.

• Recovery allegedly based on a co-accused’s statement could not be used against the appellant after that co-accused was acquitted.

• Section 106 Evidence Act does not relieve the prosecution of its primary burden to prove the case.

🔎 Supreme Court held:
The prosecution had failed to collect substantive evidence connecting the accused with the crime. The conviction was therefore set aside.
